开放教育学生权益保护制度研究^*

【摘要】开放教育是以学生为中心，应用多种教学方式和手段，满足学生各种学习需求的一种教学模式。开放教育学生与学校形成平等的教育消费合同关系，其学生权益主要体现在对教育消费的自主选择权、对教育服务质量的保障权，以及权益侵害后的法律救济权等方面。本研究分析了当前开放教育学生权益保护存在问题，并借鉴国外立法经验，提出构建我国开放教育学生权益保障体系。该体系包括健全教育法律法规，实现依法治校；规范学校规章制度，保障教学质量；完善法律救济制度，维护学生权益。

Research on the Systems in Protecting Students′ Rights and

Benefits in Open Education Institutions

Abstract: Open education tends to be student-centered, and is a teaching model that applies a variety of teaching methods to meet students' learning needs. Students in open education develop an equal relationship with the educational institutions. Students' rights and benefits mainly lie in their educational choices, their assurance in the quality of educational services, and access to legal remedies if their rights are violated. This paper presents the construction of systems to guarantee students' rights in Chinese's open and distanle instutitions. This is accomplished through an analysis of existing problems in these areas, and through learning from foreign experiences in legislation. The paper advocates that regularizing rules and regulations in educational institutions is to ensure the quality of teaching. Improving the legal remedies system is to further guard students' rights and benefits
